ZAIRON MOTOR, S.L. — ZAIRON 5-YEAR WARRANTY

GENERAL WARRANTY CONDITIONS

1. PURPOSE AND SCOPE

These General Conditions regulate the legal and commercial warranty applicable to vehicles marketed by ZAIRON MOTOR, S.L., with CIF B21950282 and registered office at Calle Retama, 7, Planta 12, 28045 Madrid.

This warranty shall apply exclusively to vehicles imported and marketed by ZAIRON MOTOR, S.L. within Spanish territory.

The commercial warranty regulated in this document complements, but does not replace or limit, the rights corresponding to the consumer under current legislation, in particular Royal Legislative Decree 1/2007 (TRLGDCU), amended by Royal Decree-Law 7/2021, of April 27, which incorporated Directive (EU) 2019/771 on contracts for the sale of goods.

2. LEGAL CONFORMITY WARRANTY

All ZAIRON vehicles have a legal conformity warranty in accordance with the provisions of the TRLGDCU (Articles 114 et seq.).

The legal warranty period will be three (3) years from the date of delivery of the vehicle to the consumer. For these purposes, the delivery date will be understood as the registration date or, if the vehicle remains unregistered, the date of sale to the user, meaning the day appearing on the sales invoice. There is no mileage limit during this entire period.

During the first two years from delivery, defects that appear are presumed to be original, unless proven otherwise. From the third year, it is up to the consumer to prove that the defect existed at the time of delivery.

In the event of a lack of conformity, the consumer shall have the right, in the first instance, to the repair or replacement of the good and, if these are not possible or are not carried out within a reasonable period, to a price reduction or termination of the contract, in accordance with the terms of the TRLGDCU.

Legal basis: Arts. 114-127 ter TRLGDCU (RDL 1/2007, amended by Royal Decree-Law 7/2021).

3. ZAIRON COMMERCIAL WARRANTY — VOLUNTARY EXTENSION

In addition to the legal warranty, ZAIRON MOTOR, S.L. offers a voluntary commercial warranty that extends the vehicle's coverage to a total of five (5) years from the date of delivery. This extension is valid only for units sold under the "ZAIRON 5-YEAR WARRANTY" campaign.

The commercial warranty will have a maximum cumulative duration of five (5) years and a maximum limit of fifty thousand kilometers (50,000 km), applying the criterion that is met first.

The guarantor of the commercial warranty extension is ZAIRON MOTOR, S.L., with CIF B21950282 and registered office at Calle Retama, 7, Planta 12, 28045 Madrid. This commercial warranty is applicable throughout Spanish territory.

4. CONDITIONS FOR MAINTAINING THE COMMERCIAL WARRANTY

To keep the ZAIRON commercial warranty valid, it will be mandatory to:

  • Comply fully with the maintenance plan established by ZAIRON ("ZAIRON 5-Year Maintenance Plan").
  • Perform these revisions exclusively at the ZAIRON Official Service network published on www.zaironmotor.com.
  • Use exclusively original spare parts, components, consumables, and lubricants specified by ZAIRON.
  • Allow proper recording of all maintenance operations in the ZAIRON management system (SWAN).

Failure to comply with any of the above conditions may result in the loss of the additional commercial warranty, without affecting in any case the consumer's rights derived from the legal conformity warranty.

5. ZAIRON 5-YEAR MAINTENANCE PLAN

A complete description of the maintenance plan will be sent by email to the customer once the warranty activation is registered and will be available in the User Area of www.zaironmotor.com. The mandatory minimum schedule is as follows:

5.1 First inspection — All vehicles

500 km or 2 months from the date of delivery (whichever comes first).

5.2 Second inspection

  • Engines up to 125 cc: 6 months from the date of delivery or 3,000 km (whichever comes first).
  • Engines over 125 cc: 12 months from the date of delivery or 5,000 km (whichever comes first).

5.3 Third inspection

  • Engines up to 125 cc: 12 months from the date of delivery or 6,000 km (whichever comes first).
  • Engines over 125 cc: 24 months from the date of delivery or 10,000 km (whichever comes first).

5.4 Fourth inspection

  • Engines up to 125 cc: 18 months from the date of delivery or 9,000 km (whichever comes first).
  • Engines over 125 cc: 36 months from the date of delivery or 15,000 km (whichever comes first).

5.5 Fifth inspection

  • Engines up to 125 cc: 24 months from the date of delivery or 12,000 km (whichever comes first).
  • Engines over 125 cc: 48 months from the date of delivery or 20,000 km (whichever comes first).

5.6 Sixth inspection

  • Engines up to 125 cc: 30 months from the date of delivery or 15,000 km (whichever comes first).
  • Engines over 125 cc: 60 months from the date of delivery or 25,000 km (whichever comes first).

The cost of periodic maintenance inspections is borne by the customer. It is recommended to check the oil level and tire pressure every 1,000 km.

6. RECORD OF INSPECTIONS AND MAINTENANCE

The owner must require the ZAIRON Official Service to record all maintenance operations in the SWAN management tool within fifteen (15) days of the inspection.

It is recommended to request a detailed invoice for each inspection as documentary support. ZAIRON MOTOR, S.L. may request such supporting documentation to verify compliance with the plan.

7. WARRANTY COVERAGE

The warranty will cover manufacturing, assembly, or material defects that affect the correct functioning of the vehicle, recognized by ZAIRON according to its technical procedures.

Once the warranty intervention is authorized, ZAIRON will implement one of the following solutions:

  • Replacement of the non-conforming part.
  • Repair of the non-conforming part.

Materials and labor will be free of charge for the customer. Ownership of replaced parts will pass to ZAIRON MOTOR, S.L. Other indirect damages or expenses are not covered.

If, during the repair, it turns out that it is not covered by the warranty, the cost incurred up to that moment will be entirely borne by the owner, even if ZAIRON had initially accepted the repair as a precautionary measure.

8. WARRANTY EXCLUSIONS

The following cases are excluded from the warranty:

8.1 Parts with limited wear life

Items subject to normal wear and tear from use are not covered by the warranty beyond the indicated periods (counted from the date of sale):

  • 30 calendar days: spark plugs, air/oil/fuel filters, bulbs, lamps, LEDs, fuses, textile materials, rims and their balancing, tires and inner tubes.
  • 90 calendar days: drive belt or chain, clutch, variator, steel cables, bearings, gaskets, brake shoes, brake pads, discs and drums, steering axle, rubber mounts, mechanical or electrical controls, brushes, aesthetic damage from use.
  • 180 calendar days: batteries.

8.2 General exclusions

  • Damage caused by accidents, impacts, or falls, unless arising from a manufacturing defect.
  • Modifications not expressly authorized in writing by ZAIRON, including kits that alter the original characteristics of the vehicle.
  • Use of non-original ZAIRON spare parts or unspecified lubricants.
  • Repairs performed outside the official ZAIRON network when they affect elements related to the claimed incident.
  • Failure to comply with the mandatory maintenance plan.
  • Improper, negligent use, or use contrary to the manufacturer's instructions.
  • Vehicle participation in sports competitions, rental, or unauthorized professional use.
  • Vehicles with alteration or manipulation of the identification number (chassis).
  • Change or filling of fluids (coolants, lubricants, brake fluid, etc.).
  • Aesthetic damage from environmental agents (oxidation, corrosion, color loss, adhesives) or animal droppings.
  • Engine overheating damage due to improper use or insufficient coolant or lubrication.
  • Vibrations that do not affect the vehicle's operation.
  • Repair requests based on false or incorrect information.

Legal note: The limited periods in section 8.1 apply only to the commercial warranty, not to the legal conformity warranty, which cannot be reduced in any case by these conditions.

9. WARRANTY REPAIR REQUEST

In case of an incident, the owner must take the vehicle to a ZAIRON Official Service as soon as they become aware of it. The list of Official Services is available at www.zaironmotor.com.

The claim procedure is as follows:

  • Present the vehicle at a ZAIRON Official Service, providing documented proof of compliance with the maintenance plan (inspection invoices).
  • The Official Service will verify that the part causing the incident is covered by the warranty and that all maintenance conditions have been met.
  • The Official Service will report the incident to the ZAIRON Warranty Service, which will issue a resolution within a maximum of seven (7) business days from the receipt of the request.
  • ZAIRON MOTOR, S.L. reserves the right to examine the vehicle and/or the parts causing the breakdown to determine the origin of the warranty.

Legal note: The claim period against the seller for lack of conformity is three (3) years from the delivery of the vehicle (Art. 120 TRLGDCU).

10. WARRANTY TRANSFER

The warranty may be transferred to subsequent owners during the vehicle's validity period.

The transfer of the commercial warranty will be subject to proven compliance with the maintenance plan in the official ZAIRON network. In case of non-compliance, the commercial extension cannot be transferred, although the legal conformity warranty will remain valid for its legal term.

11. ZAIRON USER AREA

ZAIRON provides its customers with a User Area accessible at www.zaironmotor.com. It is recommended to register the vehicle on this platform to:

  • Consult the documentation associated with the vehicle.
  • Access the updated maintenance plan and nearby Official Services.
  • Receive communications related to inspections and maintenance.
  • Keep vehicle documentation organized.

The User Area is a support tool and does not replace the obligations established in these conditions.

12. PERSONAL DATA PROTECTION

Personal data provided in connection with warranty management will be processed by ZAIRON MOTOR, S.L. (CIF B21950282), as the data controller, for the purpose of managing the warranty of the acquired vehicle and associated maintenance communications.

Such processing will be carried out in accordance with Regulation (EU) 2016/679, of April 27, 2016 (GDPR), and Organic Law 3/2018, of December 5, on Personal Data Protection and Guarantee of Digital Rights (LOPDGDD).

The data subject may exercise their rights of access, rectification, erasure, restriction, portability, and objection by contacting posventa@zaironmotor.com or by postal mail to the registered office. Full information on data protection is available in the Privacy Policy published at www.zaironmotor.com.

14. DISPUTE RESOLUTION AND CLAIMS

In case of disagreement with the response received, the consumer may resort to:

  • Consumer Arbitration System: in accordance with Royal Decree 231/2008, of February 15, before the competent Consumer Arbitration Boards.
  • Consumer protection organizations of the corresponding Autonomous Community or municipal consumer information offices (OMIC).

Ordinary judicial procedure before the competent Spanish courts.

The foregoing is without prejudice to the consumer's right to resort to judicial proceedings at any time.

15. APPLICABLE LEGISLATION

This warranty shall be governed and interpreted in accordance with current Spanish legislation, in particular:

  • Royal Legislative Decree 1/2007, of November 16, TRLGDCU, in its current wording.
  • Royal Decree-Law 7/2021, of April 27, reforming the TRLGDCU (transposition of Directive (EU) 2019/771 and 2019/770).
  • Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).
  • Royal Decree 231/2008, of February 15, regulating the Consumer Arbitration System.
  • Other applicable state and autonomous consumer regulations.

Nothing in this document shall limit the rights corresponding to the consumer in accordance with the applicable mandatory regulations. In case of conflict, the regulation most favorable to the consumer shall prevail.
